ACAS have launched a consultation on a draft Code of Practice on handling requests for a predictable working pattern.

The Code of Practice will apply alongside the Workers (Predictable Terms and Conditions) Act 2023 which received Royal Assent in September 2023 and is expected to come into force in September 2024.

The new legislation will give employees and workers a right to request a predictable work pattern under the Employment Rights Act 1996, subject to certain eligibility criteria. The Act applies in England, Wales and Scotland.

ACAS were asked by the Department for Business and Trade (DBT) to prepare a new statutory Code of Practice to provide guidance on the new legislation and will also be producing new non-statutory guidance.

The consultation on the draft Code of Practice ends on 17 January 2024.

Anthony Collins Solicitors LLP have written a blog explaining the current understanding of the legislation, which employers may find helpful.

Homecare Association members are invited to send their views on the draft Code of Practice to [email protected].
